    No. Alabama officially eliminated marriage licenses in 2019. You cannot go to a courthouse ahead of time to get a license. Instead, you download the legal Alabama Marriage Certificate document directly from the Alabama Department of Public Health (ADPH) website, complete it yourselves, and get your signatures notarized.


    18 years or older: You can legally marry on your own. If you are 16 to 17 years old: You can legally marry, but only if you have the official consent of a parent or legal guardian. Under 16 years old: It is completely illegal to marry. There are no exceptions to this rule, even with parental approval or a pregnancy.


    Your legal date of marriage is the date you sign the form in front of an Alabama notary.


    If you want your legal marriage date to match the actual day of your wedding ceremony, you must find an Alabama notary who is willing to meet you and notarize your signatures on that exact day.


    Legally, no. The State of Alabama considers marriage a civil contract. A wedding ceremony, a religious leader, a judge, or an officiant is completely optional. Your marriage is legally established strictly by the proper execution and recording of the document.


    No. Alabama enforces a strict 60-day waiting period after a divorce decree is issued before either party can legally remarry anyone else.


    No. The document must be notarized by a notary public commissioned by the State of Alabama. If you live out of state and plan to travel to Alabama for a destination wedding, you cannot have your local hometown notary sign it before you leave. The physical notarization must happen within Alabama's borders by an Alabama-commissioned notary.


    No. Alabama does not require any witnesses. The only people signing the document are the two spouses and the notary.


    You have a strict window of 30 calendar days from the final signature date on the form to deliver the original, notarized document to an Alabama county probate court. If you miss this 30-day deadline by even one day, your paperwork becomes invalid, and you have to start the entire process over.


    Technically, state law requires the form to be legible, but most county probate courts will strictly reject handwritten forms. To prevent your paperwork from being turned away, you should always use the official, fillable PDF from the ADPH website, type your information directly into the fields, and then print it out for signing in the presence of a notary.
